Most people arrested in Harris County have never been arrested before. The system knows that, and it has built paths for them. Brian Foley explains the options in this video — and why they do not happen by themselves.
The off-ramps
Dismissal. The best outcome. The case is dropped — because the evidence is weak, because the complainant is unavailable, or because the defense showed the prosecutor something the offense report left out. A dismissed case can be expunged, erasing the arrest entirely.
Pretrial intervention / diversion. Harris County offers programs for eligible first-time defendants in many misdemeanors and some felonies. Complete the conditions — classes, community service, a clean record for a period — and the case is dismissed and eligible for expunction.
Deferred adjudication. A plea without a conviction. Complete probation successfully and the case is dismissed. It is not expungeable, but for most offenses it can be sealed with an order of nondisclosure, which hides it from private background checks.
Reduction. A felony reduced to a misdemeanor, a Class A to a Class C, an assault family member to a non-family-violence offense. Reductions protect firearm rights, immigration status, and professional licenses.
What "preparation" means
None of these outcomes is automatic. Diversion has eligibility rules and an application. Dismissals require the prosecutor to see the weakness in the case. Reductions require negotiation and mitigation. Expunctions and nondisclosures require separate petitions after the case ends. Each step has a deadline and a form, and each one is where an unprepared defendant loses an outcome they qualified for.
