Headlines about SB 2024 made it sound as if Texas had just banned THC vapes. It had not — because for consumers, they were never legal. Brian Foley explains the layers in this video.
Layer 1 — The consumer (unchanged)
Possession of THC concentrate — the contents of any THC vape cartridge — is a Penalty Group 2 offense under Health & Safety Code § 481.116, a state jail felony at the lowest level. That was true before SB 2024 and is true after it. The only consumer-side question that remains open is whether hemp-derived cannabinoids (delta-8, delta-10, THCA) fall inside the 2019 hemp carve-out — a question the courts and the Legislature have not resolved. Layer 2 — The seller (new)
SB 2024 added a Class B misdemeanor for marketing, advertising, or selling an e-cigarette that contains a cannabinoid — any cannabinoid, hemp-derived or not — along with products containing alcohol, kratom, kava, mushrooms, or controlled substances, products made in China, and products disguised as other items. This is the change: a smoke shop selling delta-8 vapes now faces criminal liability under a statute that does not depend on how the delta-8 question is answered.
Layer 3 — The Legislature
In the same 2025 session, the Legislature passed a broad ban on consumable THC products (SB 3), which the Governor vetoed, followed by a special-session effort and regulatory rulemaking. The status of hemp-derived THC products in Texas is, as of this writing, governed by a patchwork of the 2019 hemp law, DSHS rules, litigation, and SB 2024's retailer provisions. Expect it to keep changing.
What it means in a Harris County courtroom
For a consumer charged with a THC cartridge, SB 2024 is irrelevant — the defense is the same as before: the search, the lab's ability to identify and quantify the cannabinoid, knowledge, and diversion eligibility. For a retailer, SB 2024 is a new exposure that makes the "it's legal hemp" argument much weaker at the point of sale.
