"Intoxicated" is not a feeling — it is a statutory definition with two prongs. Brian Foley explains § 49.01(2): not having the normal use of mental or physical faculties by reason of alcohol, a drug, or a combination, or an alcohol concentration of 0.08 or more. The State only needs one, and the defense must be ready for both.
