Brazoria County or Harris County? Why It Matters
Brazoria County (most of Pearland: old Pearland, Broadway, Pearland Parkway, Silverlake, most of Shadow Creek Ranch). Cases go to the Brazoria County Courts at Law (misdemeanors) and District Courts (felonies) at the Brazoria County Courthouse, 111 E. Locust Street, Angleton, TX 77515 — about 30 miles south of Pearland. Brazoria County sets bonds by schedule and generally requires a cash or surety bond, personal bonds are less common than in Harris County, and the Brazoria County District Attorney runs its own pretrial diversion program with its own eligibility rules. Arrests are made by Pearland PD, the Brazoria County Sheriff's Office, the Brazoria County Precinct 1 Constable, and DPS.
Harris County (the north strip along Beltway 8, parts of Shadow Creek Ranch, and the Pearland ETJ north of Clear Creek). Cases go to the County Criminal Courts at Law and felony District Courts at 1201 Franklin. Harris County's misdemeanor bail rules mean most first-time misdemeanor defendants are released on a general order or personal bond, and the District Attorney's Office runs formal pretrial diversion and marijuana diversion programs. Arrests are made by Pearland PD, HPD, the Harris County Sheriff's Office, the Precinct 1 and Precinct 7 Constables, and DPS.
Fort Bend County (far west Pearland near FM 521). Cases go to the Fort Bend County Justice Center in Richmond.
Because Pearland PD's jurisdiction crosses all three lines, a Pearland PD arrest can be filed in any of them. We confirm the county and the court on the first call.
What Happens After a Pearland Arrest
Booking. Pearland PD books at police headquarters, 2555 Cullen Parkway. Class C cases post bond there and go to the Pearland Municipal Court. Brazoria County Class A/B misdemeanor and felony arrestees are transferred to the Brazoria County Jail in Angleton; Harris County arrestees go to the Harris County Joint Processing Center at 700 N. San Jacinto in downtown Houston.
Magistration and bond. A magistrate finds probable cause, sets bond, and imposes conditions — usually within 24 hours. In a family-violence case an emergency protective order is nearly automatic. Having a lawyer before this hearing means an argument for a lower bond or personal bond, reasonable conditions, and no damaging statements.
First court setting. Two to four weeks after release in the assigned court. Nothing about guilt is decided; the case is reset for the State to produce the offense report, body-camera video, and lab results, and the defense begins.
DWI Enforcement in Pearland
SH 288 between Pearland and the Medical Center is one of the most heavily patrolled DWI corridors south of Houston, with Pearland PD, DPS, HPD, and the Brazoria County Sheriff's Office all making arrests, and Pearland PD's traffic unit works FM 518 and Pearland Parkway on weekend nights. Both Brazoria and Harris Counties run No Refusal periods where a refused breath test is answered with a judge-signed blood warrant.
