How the Fort Bend County Courts Work
Fort Bend County has its own set of courts and its own way of doing things, and lawyers who practice only in Harris County are often surprised by the differences.
Misdemeanors — Class A and B — are heard in the Fort Bend County Courts at Law at the Justice Center in Richmond. Felonies are heard in the Fort Bend County District Courts in the same building. Both are about 10 miles from Sugar Land on US-90A or US-59.
Bonds. Fort Bend magistrates set bonds by schedule and most defendants post a cash or surety bond through a bondsman; personal bonds are available but granted far less often than in Harris County. Bond conditions — an ignition interlock in DWI cases, no-contact orders in family-violence cases — are enforced strictly.
Appearances. Fort Bend judges generally expect the defendant to appear at every setting unless the court has excused a specific date, and a missed setting results in a bond forfeiture and a warrant.
Diversion. The Fort Bend County District Attorney's pretrial intervention program can end a first-offense DWI, marijuana, or theft case in a dismissal and expunction, but eligibility, application timing, and program terms are different from Harris County's and the application is a genuine advocacy exercise. We know what the Fort Bend prosecutors look for.
What Happens After a Sugar Land Arrest
Booking. Sugar Land PD books at the Sugar Land Jail, 1200 Highway 6 South. Class C cases post bond there and go to the Sugar Land Municipal Court. Class A/B misdemeanor and felony arrestees are transferred to the Fort Bend County Jail, 1410 Ransom Road, Richmond. Fort Bend County Sheriff's Office and constable arrests go there directly.
Magistration and bond. Within about 24 hours a Fort Bend magistrate finds probable cause, sets bond, and imposes conditions. In a family-violence case an emergency protective order is nearly automatic. Having a lawyer before this hearing means an argument for a lower bond or personal bond, reasonable conditions, and no damaging statements.
First court setting. Usually two to four weeks after release in the assigned County Court at Law or District Court. Nothing about guilt is decided; the case is reset for the State to produce the offense report, body-camera video, and lab results, and the defense begins.
DWI Enforcement in Sugar Land
The Southwest Freeway through Sugar Land, US-90A, and SH 6 are heavily patrolled by Sugar Land PD's traffic unit, DPS, and the Fort Bend County Sheriff's Office, and Fort Bend County runs No Refusal operations on holidays and most weekends: a refused breath test is answered with a judge-signed blood warrant and a blood draw at the jail or a hospital.
